Chattels and Fixtures
Chattels are items of personal property in a home, although they might be connected by pipes and wires. Examples are: refrigerator, stove, washer, dryer. Fixtures are items that have been attached to the property, becoming part of the home itself. Examples are: built-in shelving, broadloom and light fixtures.
In and offer, buyers must list which chattels the seller will leave behind, while sellers must state which fixtures they can remove.
Since there is sometimes a grey area about which is a chattel and which is a fixture, it is best to be clear about all items remaining with the house or being removed to go with the seller. Example: Exclude dining room light fixture and include garage door opener with two remotes.
Whether you're a buyer or seller, it's best to be specific in the Agreement of Purchase and Sale so there will be no confusion upon closing.

It's a good idea to protect yourself by making your offer conditional upon a satisfactory report from a qualified home inspector.
Home inspectors examine the major systems in the house, plumbing, heating, electrical, plus the roof, windows, foundation and insulation. They'll provide the buyer with a detailed written report. If any major problems arise, this is the time the buyer can decide not to go ahead with the purchase and get the deposit back.
A home inspection usually cost two or three hundred dollars, but for the peace of mind provided, it's a small price to pay. Home inspectors are not regulated or licenced.
Be sure you hire an inspector who is reputable and qualified. Ask your real estate agent for a referral.

Buying and selling real estate has become very specialized in the last few years. So when, you're looking for a lawyer, make sure it's a real estate lawyer, one who spends most of the time closing real estate deals.
Your real estate agent or banker can recommend several good lawyers. Ask friends, family and neighbours for recommendations. ]
Never choose a real estate lawyer just because their fees are the lowest. As with any other professional, quality and experience are the key to service, not just price.
